By accessing and using BuildNexus services, including our website, mobile applications, and retail locations, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

These Terms and Conditions constitute a legally binding agreement between you and BuildNexus Corporation, a Florida corporation with its principal place of business at 1000 W State Rd 84, Fort Lauderdale, Florida 33315.

2. Use License

Permission is granted to temporarily download one copy of the materials on BuildNexus's website for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:

• modify or copy the materials
• use the materials for any commercial purpose or for any public display (commercial or non-commercial)
• attempt to decompile or reverse engineer any software contained on BuildNexus's website
• remove any copyright or other proprietary notations from the materials

This license shall automatically terminate if you violate any of these restrictions and may be terminated by BuildNexus at any time. Upon terminating your viewing of these materials or upon the termination of this license, you must destroy any downloaded materials in your possession whether in electronic or printed format.

3. Product Information and Pricing

BuildNexus strives to provide accurate product descriptions, specifications, and pricing information. However, we do not warrant that product descriptions or other content is accurate, complete, reliable, current, or error-free.

All prices are subject to change without notice. We reserve the right to modify or discontinue products at any time without notice. In the event of a pricing error, BuildNexus reserves the right to cancel orders placed at the incorrect price.

Professional installation services are provided by licensed third-party contractors. BuildNexus acts as a facilitator and is not responsible for the quality of installation services.

4. In-House Credit Services and Financial Terms

BuildNexus offers in-house credit services directly to qualified customers. We do not use third-party financial institutions or credit card companies. All credit decisions are made internally by BuildNexus based on our own criteria and risk assessment.

Our standard credit offering features 0% APR (Annual Percentage Rate) for qualified customers. Credit approval is subject to BuildNexus's internal creditworthiness evaluation and other factors determined solely by BuildNexus management.

By applying for BuildNexus credit, you authorize us to verify information provided in your application and to make credit decisions based on our internal policies. Payment terms, credit limits, and repayment schedules are determined by BuildNexus and will be clearly outlined in your credit agreement.

As we provide direct financing without external lenders, we maintain full control over credit terms, payment processing, and account management. All credit accounts are serviced directly by BuildNexus customer service representatives.

5. Privacy and Data Protection

Your privacy is important to us. Our Privacy Policy, which is incorporated by reference into these Terms, describes how we collect, use, and protect your personal information.

We implement appropriate security measures to protect your personal information against unauthorized access, alteration, disclosure, or destruction. However, no method of transmission over the Internet or electronic storage is 100% secure.

You have the right to access, update, or delete your personal information. Contact our customer service team for assistance with your data rights.

6. Returns and Refunds

Most items may be returned within 90 days of purchase with original receipt. Some restrictions apply to special order items, cut materials, and hazardous materials. See our Return Policy for complete details.

Refunds will be processed to the original form of payment. Credit card refunds may take 3-5 business days to appear on your statement.

Items must be in original condition and packaging. BuildNexus reserves the right to refuse returns that do not meet our return policy requirements.

7. Limitation of Liability

In no event shall BuildNexus or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on BuildNexus's website, even if BuildNexus or a BuildNexus authorized representative has been notified orally or in writing of the possibility of such damage.

Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.

8. Governing Law

These terms and conditions are governed by and construed in accordance with the laws of the State of Florida, and you irrevocably submit to the exclusive jurisdiction of the courts in that state or location.

Any disputes arising under these terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

9. Changes to Terms

BuildNexus reserves the right to revise these terms of service at any time without notice. By using this website, you are agreeing to be bound by the then current version of these terms of service.

Material changes to these terms will be communicated through our website or via email to registered users. Continued use of our services after such changes constitutes acceptance of the new terms.
