What is the Fair Credit Reporting Act (FCRA)?
The Fair Credit Reporting Act (FCRA) is a federal law that regulates the collection, dissemination, and use of consumer information, including consumer credit information. The FCRA governs access to consumer report records and promotes accuracy, fairness, and privacy of personal information assembled by Credit Reporting Agencies (CRAs).
BuildNexus complies with all FCRA requirements when obtaining and using consumer credit information for credit decisions, employment screening, and other permissible purposes.
Your Rights Under the FCRA
As a consumer, you have specific rights under the FCRA regarding your credit information:
Access Your Credit Report
You have the right to obtain a free copy of your credit report from each of the three major credit bureaus once per year.
Dispute Inaccurate Information
You can dispute incomplete or inaccurate information in your credit report directly with the credit reporting agency.
Know Who Accessed Your Report
You have the right to know who has accessed your credit report within the past year (or two years for employment purposes).
Limit Prescreened Offers
You can opt out of prescreened credit and insurance offers by calling 1-888-5-OPTOUT or visiting optoutprescreen.com.
BuildNexus Credit Reporting Practices
When you apply for credit with BuildNexus, we may obtain information about you from consumer reporting agencies. This information helps us make informed credit decisions and may include:
- Credit history and payment patterns
- Current credit accounts and balances
- Public records information
- Previous credit inquiries
- Identity verification information
We use this information solely for legitimate business purposes, including credit decisions, account management, and fraud prevention. We do not share your credit information with unauthorized third parties.
Adverse Action Notices
If we take adverse action against you based on information in your credit report (such as denying credit, reducing credit limits, or offering less favorable terms), we will provide you with an adverse action notice that includes:
- The name, address, and phone number of the credit reporting agency that provided the report
- A statement that the credit reporting agency did not make the decision and cannot explain why the decision was made
- Your right to obtain a free copy of your credit report within 60 days
- Your right to dispute inaccurate or incomplete information in your credit report
Identity Theft Protection
BuildNexus takes identity theft seriously and has implemented measures to protect your personal information:
- Secure data transmission and storage protocols
- Identity verification procedures for credit applications
- Monitoring for suspicious account activity
- Prompt notification of potential security breaches
- Assistance with identity theft resolution
If you believe you are a victim of identity theft, contact us immediately at 1-800-BUILD-NOW and place a fraud alert on your credit reports by contacting one of the three major credit bureaus.
